Seven months after Shuckers Bar & Grill received national attention for a wooden deck collapse that caused numerous patrons to plunge into Biscayne Bay while watching the Miami Heat play in the NBA finals, the North Bay Village restaurant’s owners have the go-ahead to start rebuilding.

Barges with large hoists could be seen clearing the waters behind Shuckers last week, the Miami Herald reported. The remaining pieces of the collapsed deck are to be transferred to a warehouse to allow forensics experts to reconstruct it so the insurance company representing the restaurant can figure out why the June incident happened. Ten civil lawsuits against the restaurant’s owners are pending in Miami-Dade Circuit Court.

One personal injury attorney involved told the Herald he expects a settlement to be reached between the victims and restaurant.

Meanwhile, the Shuckers owners have secured permits from North Bay Village to rebuild the restaurant. Plans call for the foundations holding the roof and canopy to be replaced, and the retaining wall along the water to be raised. The new deck would be made of concrete instead of wood.
